Www.likecharlieclothing.com ("website") is operated on behalf of Like Charlie, a general partnership officially registered with the Chamber of Commerce under number 89110692 with VAT number NL004693345B73. Hereinafter referred to as "Like Charlie", "we", "us" and "our".

Applicability

The Terms apply to your use of our website, all of our product offerings on our website, as well as your experience with them and your purchases. These terms also apply to all purchases from us that you make outside our website.

Using our website means you agree to and are bound by the terms.

Availability and delivery

While items may be viewed as available on the website, we cannot guarantee the availability of the item and it may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, make unavailable or cancel an order for any or all items. If this is the case, we may, at our discretion, ship items that have substantially the same functionality and specifications as the item ordered.

In accordance with the above, purchased items will be shipped within five working days from the date of the order, excluding force majeure situations that arise during the processing of shipments. If you have not received your purchased item after three weeks, please let us know by email.

The customer bears all import duties and customs costs for orders placed outside the Netherlands.

Where possible, we try to deliver all items ordered by you at the same time. Please note, however, that items may be delivered in separate shipments. As a result, we reserve the right to deliver your order in separate shipments.

Colors and sizes

We have made every effort to display the colors of our products as accurately as possible on our website. However, because the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's representation of any color will be accurate. Please check carefully which size our models wear, because Like Charlie always chooses its own sizes for the items.

Order process and agreement

You can only place an order if you 1) are a consumer, and 2) if you are 16 years or older or have permission from at least one of your parents and/or guardians and 3) provide us with the correct information necessary to fulfill the order.

An order placed by you is an offer to purchase the item(s). It must be accepted by Like Charlie. Once the order has been placed, we will send you an order confirmation email to let you know that we have received the order. This confirmation email does not constitute acceptance of your order or the formation of a contract. Like Charlie reserves all rights to refuse your order for any reason and without liability to you or any third party.

Our acceptance of your order and the conclusion of the contract will only take place after we have sent you an e-mail confirmation that your order has been dispatched. Before your order is shipped, we may cancel your order at any time for any reason.

Right of withdrawal

As a consumer you can revoke a placed order. If you notify us within 14 days, we will refund all payments you have made to us for the canceled order, including delivery costs (where applicable and up to the cheapest standard delivery we offer). However, it is important to note that you are liable for any diminished value of the item resulting from the use of the item beyond what is necessary to establish the nature, characteristics and operation of the product. The risk and the burden of proof of the correct and timely exercise of the right of withdrawal lie with you.

Prices and Payments

Prices and payments on the website are stated in euros, including VAT and excluding any shipping costs. If delivery costs apply, they will be shown during checkout. Additional costs may be charged for customers outside Europe.

Like Charlie reserves the right to 1) make changes to the prices on the website and 2) change or withdraw special offers or discounts at any time without notice. We only offer the payment method shown during the checkout process and we are not liable for any wire transfer or bank charges and/or import duties or taxes. All payments are subject to authorization and validation checks performed by the payment service provider. In the event that the payment service provider cannot accept your payment for any reason, they will notify you and we will cancel your order.

Retention of title

All items delivered to you will remain the exclusive property of Like Charlie until you: have paid in full all amounts due to us under any contract between you and us, including payment of charges, early or late deliveries or partial deliveries. You remain liable for any depreciation or damage to the product during the period between your receipt of the order and your payment.

Like Charlie can exercise the right of retention if the consumer fails to fulfill a due and payable obligation, unless the default does not justify such retention.

Guarantee

We guarantee that our articles meet the characteristics for 'normal' use. This does not include, for example: 1) The use of our articles during sports or in extreme weather conditions. 2) The use of chemicals or sharp objects on our products. 3) Modification or repair of the product by you or another third party. 4) Neglecting or improper storage of our products. 5) Poor maintenance and failure to follow our washing and care instructions. 6) Damage caused by compression, a fall, abnormal impact or handling or wear on abrasive surfaces. 7) Damage caused by UV (sunlight or other natural phenomena), fire, bleach. 8) Natural degradation of colours, finishes and materials over time.

In addition, complaints about defects (non-conformity) in the purchased product must be submitted to us as soon as possible and no later than two months after discovery. You must return the broken product in accordance with the return policy and with the original proof of purchase. Like Charlie will replace the product that cannot be used properly due to a manufacturing defect, provided that the item is still available. If the item is not available and you do not accept a comparable item (if possible), we will find another suitable solution at our discretion.

We are also not liable for defects or consequential damage that arise after the delivery of the items as a result of improper / normal use or carelessness, or that are the result of changes or repairs that you or third parties have made to the delivered items.

Limitation of Liability

The Like Charlie warranty does not cover damage to an item if the damage is the result of the consumer's acts or omissions.

If an item does not meet the specifications, your rights and our liability are limited to repair of sound items, price reduction, replacement of such product or refund of the price of such product, at Like Charlie's option.

Our obligations in this section are conditioned upon your full compliance with our terms and conditions, shipping policy, returns policy and privacy policy.

Change of Terms.

Like Charlie reserves all rights to make changes to these terms and conditions, shipping policy, returns policy and privacy policy from time to time. Your use of our website following any such change constitutes your agreement to follow and be bound by the amended policy/terms.
